1. Acknowledgment of Risk

I, the purchaser and/or participant ("Participant"), understand and acknowledge that participation in fitness training, exercise programs, nutrition coaching, wellness activities, retreats, group classes, outdoor activities (including kayaking, boot camps, and similar activities), and any other services or activities offered by Fit.Done.Well. ("Company") involves inherent risks of physical injury, illness, property damage, or death.

These risks include, but are not limited to: muscle strains, sprains, overexertion, falls, equipment-related injuries, cardiovascular events, dehydration, and other conditions that may arise from physical exertion. I understand that these risks cannot be fully eliminated even with the Company's best efforts.

2. Voluntary Participation

I confirm that my participation in all Fit.Done.Well. programs, services, and activities is entirely voluntary. I have had the opportunity to consult with a licensed physician prior to participation and have been advised of any physical conditions or limitations that may affect my ability to safely participate.

3. Medical Fitness Representation

I represent and warrant that I am physically fit and have no medical condition, injury, or illness that would prevent my safe participation in the program or activity. I understand it is my sole responsibility to disclose any medical condition or limitation to my coach or instructor prior to participation.

4. Release of Claims

In consideration of being permitted to participate in Fit.Done.Well. programs, services, and activities, I, on behalf of myself and my heirs, successors, executors, and administrators, hereby release, waive, discharge, and covenant not to sue Fit.Done.Well., its owners, members, coaches, instructors, employees, agents, contractors, successors, and assigns (collectively, "Released Parties") from any and all claims, demands, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising out of or related to my participation in any Fit.Done.Well. program, service, or activity — whether caused by the negligence of the Released Parties or otherwise.

5. Indemnification

I agree to indemnify and hold harmless the Released Parties from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) incurred by the Released Parties as a result of: (a) my participation in any Fit.Done.Well. program or activity; (b) my breach of this Agreement; or (c) my violation of any applicable law or the rights of a third party.

6. Photography & Media Release

By participating in Fit.Done.Well. programs, events, and activities, I grant permission to Fit.Done.Well. to use photographs, videos, and testimonials featuring me for marketing, promotional, and educational purposes, including on the website, social media, and print materials. I waive any right to compensation or approval of such use. If you do not consent to this use, please notify us in writing at fitdonewell@gmail.com before participation.

7. Equipment Use

I agree to use all equipment and facilities in a safe and appropriate manner, following all instructions provided by Fit.Done.Well. coaches and staff. I accept full responsibility for any damage caused by my misuse of equipment.

8. Emergency Medical Treatment

In the event of an emergency during my participation in any Fit.Done.Well. activity, I authorize Fit.Done.Well. coaches and staff to seek emergency medical treatment on my behalf and agree to be responsible for all associated costs.

9. Severability

If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10. Entire Agreement

This Waiver, together with our Terms & Conditions, Health Disclaimer, and Refund Policy, constitutes the entire agreement between the Participant and Fit.Done.Well. regarding the subject matter herein.

11. Governing Law

This Agreement shall be governed by the laws of the State of Arizona. Any dispute arising under this Agreement shall be resolved in the courts of Arizona.
